Applicability
A.
By
visiting, using or ordering from this website, you expressly agree to be bound
by the following terms and conditions and to adhere to these Terms and
Conditions and all applicable laws and regulations governing this web site.
B. These
terms and conditions shall apply to all orders, booking confirmations and
agreements where Official-Ticket acts as the seller of tickets. Additions to or
deviations from these terms and conditions shall only apply if accepted in
writing by Official-Ticket. No rights can be derived from any promises made by
any Official-Ticket employee unless they have been confirmed in writing by
Official-Ticket.
C. General terms and conditions of clients/customers shall not apply unless
their applicability has been accepted explicitly in writing by Official-Ticket.
D. If you break these Terms and Conditions, Official-Ticket reserves the right
to prevent your future use of this web site, cancel your order request, and/or
take appropriate legal action against you.
E. Official-Ticket reserves the right to change these Terms and conditions at
any time. Posting updated terms on this site will make these terms effective
immediately and binding on all users of this Website without exception.
Therefore, please check this page of the Website periodically for updates.
F. Since event tickets are purchased in a free and fluctuating Market, ticket
prices are subject to change at any time. For up-to-date, current prices, please
call or consult our website.
2. Definitions
- Official-Ticket: is a trading name of the private company with limited
liability Official-Ticket Ltd.
- Ticket: admission ticket for an event.
- Client: the person who concludes an agreement with Official-Ticket to provide
tickets (admission tickets) for events such as sport (football, rugby, formula1,
Olympic games...etc), concerts, theatre, etc.
- In writing: a letter put down on paper as well as a message that has been
prepared and defined electronically.
- Booking confirmation: a written confirmation provided by Official-Ticket of
the booking placed by the client regarding a booking that is sent by
Official-Ticket to the (e-mail) address specified by the client.
3. Agreement
conclusion
A. Official-Ticket offer shall be deemed to have been accepted by the client
should said client have specified in the Official-Ticket booking procedure which
ticket(s) said client wishes to receive as well as having filled in the other
information and this booking has been received by Official-Ticket after it has
been sent.
B. A client shall also be deemed to have accepted a Official-Ticket offer if
said client has passed on the required information through the phone to
Official-Ticket.
C. An agreement shall be concluded once Official-Ticket has confirmed the
client's acceptance of a Official-Ticket offer through an order/booking
confirmation in writing. Official-Ticket shall not be obliged to conclude an
agreement and can decide not to conclude an agreement at its own discretion.
D. All orders are binding for the client and cannot be cancelled without written
acceptance of cancellation by Official-Ticket.
4. Prices
a. When
booking the client expressly accepting the difference in price over ticket face
value, due to changes in supply and demand, the degree of difficulty ,the cost
of obtaining and most important, the cost involved in servicing and delivering
tickets to the client position.
Official-Ticket
prices will be different from the prices that may be specified on the tickets
themselves and the client cannot derive any rights from these. All costs are
included in Official-Ticket prices excluding handling fee costs.
b. Prices are expressed in Euros or GBP unless otherwise specified.
5. Payment
A. All packages and tickets bookings offered are subject to availability.
B. All ticket prices are guaranteed at the time an order is placed, and payment
is received.
C. Accepted forms of payment are credit card (Visa, MasterCard) or Bank
transfer. Official-Ticket reserves the right to ask client to pay only by bank
transfer.
D. 100% full payment must be received in order to guarantee a ticket purchase
E. Price paid is the price shown on the website at the date and time of booking
and accepted by the client when confirming the buying during ordering in the web
site .All payments will be taken in Euro, also if the original price in the web
site was in GBP. (The exchange rate from GBP to Euro will be the same rate as
been charge by Seychelles Banks).
E. All our charges will also appear on your credit card statement under the name
of "Official-Ticket".
F. Credit card payments must be verified by the credit card company (online), or
the order will automatically be cancelled.
G. We reserve the right to security checks all orders and may request that proof
of your I.D and copy of the credit card will be sent to Official-Ticket. (In
this case un received I.D or copy of the credit card, Official-Ticket will
cancel the order).
H.
No
changes, cancellations or refunds may be made to credit card bookings once
booking has been made and accepted by Official Ticket.
As appear in the European low number 31997L0007, DIRECTIVE 97/7/EC (May 20,
1997) ¨on the protection of consumers in respect of distance contracts¨. It is
written clearly that once a client made a booking for transports (flight,
bus..etc) or accommodations (hotels ,apartments...etc) or catering or leisure
services or leisure events (Tickets), the client can´t cancel the booking. And
in case of cancelation by the client will not be any refund.
6: Delivery of tickets
A. By finishing the order, the client is asking and giving
automatically authorization to Official-Ticket to ship the client tickets by
Courier Company as OCS or FedEx or UPS or DHL or Official-tickets inside
courier.
b. Shipment and issue shall be at the expense and risk of the client. Shipment
costs are also applicable to hotel delivery and pick up of the tickets.
c. Tickets shall be sent at the expense and risk of the client via FedEx or a
similar courier. Shipments by FedEx or any local courier service are not
insured. Official-Ticket cannot be held liable for any damage should make by OCS
or FedEx or any other courier company lose and/or misplace tickets.
D. Should the client or the client hotel not accept the tickets, and the ticket
is returned to Official-Ticket by FedEx or any local courier service, the client
shall be deemed to be waiving his or her right to delivery. The client shall be
obliged to compensate Official-Ticket for the costs incurred in relation to the
return shipment.
E. Normally Tickets been ship from Official-Ticket offices 3 - 7 days before
the event (subject to change).
F. Should a delivery window not be available (due
to the late release of some tickets)
or by client request, tickets will be send to hotel address or local pick up
address near the event
,on the day of
the event.
in case of pick up point near the event ,Official Ticket will start to deliver
the tickets 2 hours before the event time till the starting of the event. (in
case of pick up point near the event ,if the client will not arrive to collect
his tickets will not be any refund).
G. Most
sport and football tickets (Premier League, Serie A & Spanish League) will be
delivered to your hotel one to two days before the event takes place. To that
extend, please provide us with your hotel details.
In case of hotel delivery, the client will be full responsible of receiving the
tickets from the courier. If the Hotel will refuse to receive the tickets from
the courier of any reason, it will be full client responsibility. (We recommend
informing your hotel about receiving the tickets).
For a more accurate dispatch time please contact our sales team nearer the time
of the event.
H. The client is obliged to inform Official-Ticket of any change in address and
where tickets can be delivered up to 72 hours before the event.
I. Official-Ticket will not be responsible to any undelivered tickets, base on
uncorrected full mail address given by the client (in this case client will be
responsible for undelivered tickets - no refund will be made).
7. Tickets
A. The client is authorize Official-Ticket that In case that will be available
only tickets in higher category then the one´s that ordered by the client,
Official-Ticket will supply to the client tickets in higher category ,and will
charge the client at the extra amount of money for the differences between the
categories for each ticket.
B.
For
each event Official-Ticket can supply to the client match day ticket or a season
ticket (card). if the client receive season ticket (card), he can use this
season ticket only for the specific date and event that he booked.
Once the event ended, the client must to return back immediately the season
ticket (card) to Official-Ticket. (base on the instructions that the client got
from Official-Ticket or from Official-Ticket supplier). These instructions can
be given by phone or by attachment letter inside the envelope with the season
ticket (card).
Client that staying in hotel (at the event city) will leave the season tickets
at the same night after the event ended ,inside an envelope at the hotel front
desk (and will write on the envelope the name of Official-Ticket or other name
(base on the instructions that the client got ).
In case that the client will not return the season ticket (card) during the
next 24 hours after the event , Official-Ticket will charge the client £100
(GBP) for each season ticket (card) for each day (from the ended of the 24
hours after the event, till receiving the season ticket back in Official-Ticket
offices).
C. The client by confirming that he agrees to the terms and conditions during
doing the order, he agreed
that the tickets for sport event, rugby matches or football matches in each
category can be in any home or away team. And the client agreed that he will not
have any claim against Official-Tickets regarding the home or away ticket. For
any kind of tickets (home or away) the client must act and wear as specified on
the ticket and by the organizers. For the home team sections you may not be
allowed to enter the venue in case you are wearing clothes in support of the
visiting team. And for the visiting team sections you may not be allowed to
enter the venue in case you are wearing clothes in support of the home team.
Doing so is therefore at the client own risk. (No refund will be made).
8. Special
provisions and liability
a. When the occasion arises and in particular in relation to music and/or
sporting events, tickets may display a name that does not match the name of the
client or user of the ticket. Official-Ticket cannot be held liable should the
client and/or the user of a ticket not be granted access to the event and/or he
or she (and/or the person for who said client has bought the ticket(s)) is
denied access as a consequence of this.
b. The client and/or the user of a ticket supplied by Official-Ticket must
behave as a good and orderly visitor of events and must follow instructions
given by or due to the organizer of an event to be visited by said client and/or
user as well as by the competent authorities.
c. Official-Ticket shall not be held liable should organizers of an event or the
authorities deny admission to the client and/or user of a ticket delivered by
Official-Ticket to an event except insofar this is due to an intentional act or
omission or gross negligence of Official-Ticket.
d. The client and/or user of a ticket shall visit an event at his or her own
risk. Official-Ticket shall not be held liable for damages, (also in cases of
undelivered tickets by Official-Ticket) that the client and/or user may suffer
while travelling from or to the event or attending such an event.
e. The quality categories specified by Official-Ticket for tickets shall not
harmonies with any categories used by the organizer of the event for which the
tickets have been issued. The client cannot derive any rights from the category
class and/or ranking.
f. The Client and/or user of a ticket supplied by Official-Ticket must obtain
information himself or herself in relation to instructions given by or on behalf
of the organizer of the event or the authorities as well as changes with regard
to the event such as starting times and similar. Official-Ticket shall not have
any obligation to further inform the client and/or user of the ticket regarding
this.
g. Events that have been cancelled or moved are at the expense and risk of the
client and cannot be regarded in any way as a shortcoming of Official-Ticket.
Official-Ticket shall not be liable to pay for compensation. Please note that it
is the responsibility of the client to be informed about the correct dates and
starting times of concerts and events.
Please note that football matches scheduled for Sundays may be changed to the
preceding Saturday to fit in with Champions League obligations and/or television
coverage. These changes can take place at very short notice. We recommend that
you make both Saturday and Sunday available when arranging your travel and to
ask your concierge or check the official websites or local press for the exact
schedules upon arrival
h. Should
an event be cancelled and should a replacement event not take place, the client
must not approach Official-Ticket but the organizer of the event in order to be
refunded the original value of the ticket if possible. Should a replacement
event take place, the client must approach the organizer of the event should
said client not be able to be present at the replacement event in order to be
refunded the original value of the ticket if possible.
I. The content of the Official-Ticket website is without obligation and the
client cannot derive any rights towards Official-Ticket in relation to the
content thereof and the included links.
j. Official-Ticket prices are subject to fluctuations related to the demand for
and the availability of tickets. The client cannot derive any rights from
increases or reductions of prices once the client has accepted a Official-Ticket
offer.
k. Any liability of Official-Ticket shall be limited to the amount that the
client has paid for the ticket involved.
l. Lost, stolen or damaged tickets cannot be duplicated.
9. Force
majeure
a. Shortcomings in relation to the execution of the agreement cannot be
attributed to a party should these not be due to the fault of the party or when
said party cannot be deemed responsible for them in accordance with the law, the
agreement or according to generally accepted standards.
b. Official-Ticket can invoke force majeure should the Official-Ticket
shortcoming be partly or fully the result of war, mobilization, riots, flooding,
fire, accidents, strikes, occupations, measures set by the government,
non-delivery of required tickets to Official-Ticket by third parties and other
unforeseen events.
10. Brochure
(Web) of Official-Ticket
a. The information stated in the brochure is subject to changes due to price
changes and/or errata. Amounts mentioned on the website are based on prices,
exchange rates, duties and taxes as they are known by Official-Ticket at the
time of its printing.
11.
Information from and about Official-Ticket
a. Official-Ticket has registered offices in Victoria, Seychelles.
b. Official-Ticket is a commercial company specialized in offering tickets for
sold-out and/or popular events and for so-called hard-to-get tickets.
c. Official-Ticket is not associated to any official point of sale or organizer.
12. Applicable
law
- This agreement shall be governed by Seychelles law. Insofar as deviating from
statutory jurisdiction rules is allowed, the competent court shall examine all
disputes that may occur between Official-Ticket and the client within the
District of Seychelles unless Official-Ticket should prefer to submit.
